These Website Terms govern your use of inklay.app (the “Website”), operated by Inklay GmbH. By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

2. Scope
These Terms apply only to the public Website. They do not govern purchases made through our Shopify-powered store, or your use of the Inklay app, an Inklay account, an Inklay device, or the related cloud service. The separate terms presented with those products and services apply to them.
Visiting the Website does not itself create a purchase, service, partnership, reseller, employment, or other contractual relationship with Inklay GmbH beyond these Terms.
3. Permitted Use
You may use the Website for lawful informational and business purposes. You must not:
- use the Website unlawfully or in a way that infringes the rights of others;
- attempt to gain unauthorised access to the Website, its infrastructure, or related systems;
- introduce malware, interfere with availability, or circumvent security measures;
- use automated requests in a manner that creates an unreasonable load or disrupts the Website; or
- misrepresent an affiliation with or endorsement by Inklay GmbH.

Mandatory rights and remedies relating to products or services you purchase are not limited by these Website Terms and are governed by the applicable sales or service terms and mandatory law.

Our Website Privacy Policy explains how we process personal data when you use the Website. Separate privacy information applies to the Inklay service and Shopify-powered store.
10. Changes to These Terms
We may update these Terms to reflect changes to the Website, our business, or applicable requirements. We will publish the revised Terms on this page and update the effective date. Changes apply from publication and do not retrospectively alter the terms of an existing purchase or service contract.
11. Governing Law and Disputes
These Terms are governed by Swiss law, excluding its conflict-of-law rules. The courts at the registered seat of Inklay GmbH have jurisdiction, subject to any mandatory place of jurisdiction or consumer protection that applies to you. If you are a consumer, these Terms do not deprive you of mandatory protections provided by the law of your country of residence.
12. General
If a provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not transfer your rights under these Terms without our consent. We may transfer these Terms as part of a reorganisation, financing, or transfer of the Website or our business, provided this does not reduce mandatory rights.
